Job Description
The Legal Head will lead the legal, regulatory, and compliance functions of the organization and act as a strategic business partner to the management team. The role is responsible for protecting the company's legal interests across land acquisitions, project development, commercial transactions, litigation, and regulatory matters.The incumbent will provide proactive legal guidance, manage contractual and statutory obligations, mitigate legal risks, and ensure compliance with all applicable laws governing the real estate sector.
Roles & Responsibilities- Develop and implement legal strategies aligned with the company's business objectives and growth plans.
- Advise the management team on legal risks, opportunities, investments, acquisitions, and day-to-day business operations.
- Represent the company in litigation matters and safeguard its legal and commercial interests.
- Monitor changes in applicable laws and regulations relating to real estate, land acquisition, urban development, environmental compliance, and corporate governance.
- Draft, review, negotiate, and finalize legal documents including Joint Development Agreements, Development Management Agreements, Lease Deeds, Sale Deeds, Agreements to Sell, Memorandums of Understanding, Contractor Agreements, Procurement Agreements, Vendor Contracts, Buyer Agreements, and other commercial contracts.
- Conduct legal due diligence and title verification for land acquisitions, development projects, and business transactions.
- Ensure the enforceability and legal soundness of all agreements and legal documentation.
- Ensure compliance with RERA, stamp duty and registration laws, municipal and urban development regulations, environmental laws, construction laws, and other applicable statutory requirements.
- Liaise with government departments, regulatory authorities, and statutory bodies for approvals, registrations, and compliance-related matters.
- Manage and oversee litigation involving land disputes, consumer complaints, contractual breaches, regulatory proceedings, and other civil and commercial matters.
- Coordinate with external legal counsel, advocates, and consultants for effective case management and legal representation.
- Develop dispute resolution and settlement strategies to minimize legal exposure and financial risk.
- Provide legal support to Sales and Marketing for buyer documentation and customer-related issues.
- Support the Finance function in matters relating to loan documentation, securities, escrow arrangements, and commercial transactions.
- Advise the Projects and Operations teams on contractor agreements, procurement contracts, project execution issues, and statutory compliances.
- Guide the Human Resources team on employment laws, labour law compliance, disciplinary matters, and employee-related legal issues.
- Identify potential legal and regulatory risks across business operations and recommend effective mitigation measures.
- Maintain a legal risk register and conduct periodic legal and compliance audits.
- Establish and strengthen legal governance frameworks and documentation processes across the organization.
- Lead, mentor, and develop the in-house legal team while ensuring effective allocation of responsibilities.
- Manage the legal department budget and optimize expenditure on external legal counsel and consultants.
- Conduct legal awareness and compliance training sessions for internal stakeholders and business teams.
- Build and maintain effective relationships with government authorities, regulatory bodies, external agencies, business partners, and other key stakeholders.
- Ensure timely and practical legal advice to support business continuity while protecting the organization's interests.
- LLB (Bachelor of Laws) from a recognized university. Specialization in Property Law, Real Estate Law, Infrastructure Law, or Corporate Law will be preferred.
- Minimum 20 years of relevant experience in legal and secretarial functions, preferably in the real estate, infrastructure, or construction industry.
- Thorough knowledge of prevailing real estate and property-related laws and regulations.
- Extensive experience in land due diligence, title verification, litigation management, and contract administration.
- Proven expertise in drafting and negotiating MoUs, Agreements to Sell, Sale Deeds, Lease Deeds, Contractor Agreements, Procurement Agreements, Buyer Agreements, and other commercial documents.
- Strong understanding of RERA, municipal laws, environmental regulations, labour laws, and other statutory compliances.
- Demonstrated experience in liaising with government authorities, regulatory bodies, and external agencies.
- Proficiency in Microsoft Office applications and legal research tools.
- Ability to manage multiple legal matters simultaneously and deliver practical business-oriented legal solutions.
- Strong strategic thinking and commercial acumen.
- Excellent drafting, negotiation, and analytical skills.
- In-depth knowledge of property laws, civil litigation, contractual matters, and real estate regulations.
- Strong relationship management and stakeholder engagement capabilities.
- High standards of integrity, ethics, and professional judgment.
- Ability to manage multiple complex legal matters under tight timelines.
- Strong leadership, communication, and decision-making skills.
